When a case reopens in discovery, opposing counsel doesn't just challenge the number. They ask what was reviewed before it was entered. That answer is in the record. Why this matters now 💡 Medical records don't arrive as a clean narrative. They arrive as hundreds of documents - scanned intake forms, duplicated referrals, EMR exports, notes buried deep. An adjuster with a full caseload can’t read all of it. The exposure isn't the number, it's the gap ⚠️ A low reserve isn't just an accounting problem, it's evidence of an incomplete review. Once opposing counsel can show a note or condition existed in the file and wasn't reflected in the reserve, the conversation stops being about the injury. It becomes about what the carrier missed. At what point does record volume become a liability risk - not just an efficiency problem? Most conversations about record volume focus on time. How long does it take to review 3,000 pages? How do we process more files faster? But that’s not the only question worth asking. What happens to review quality as volume increases? Because at some point volume stops being an efficiency problem and starts being a risk exposure problem. When reviewers are moving fast through large record sets, they miss things. Not always and not intentionally. But consistently enough that it affects outcomes. A missed pre-existing condition, treatment record, or psychiatric note - these are the kinds of errors that surface in litigation, in audits, and in claims that get reopened after settlement. The liability question isn't whether your team can get through the records. It's whether your process can demonstrate, if challenged, that the records were actually reviewed completely and accurately. Volume that outpaces process capacity creates documentation gaps, and documentation gaps create exposure.
