Does the industry really need another guidance on the Risk Based Approach in AML Compliance? The The Wolfsberg Group has once again published guidance centred on three principles. Proportionality. Prioritisation. Effectiveness. Interestingly, some of the discussion around the guidance has questioned whether another publication on the Risk Based Approach is even necessary. I recently came across Professor Louis De Koker's observation: "While the sentiments are laudable, clarity about the relationship between priorities and risks, and about how longer term priorities are to be set, is required." I believe that observation gets to the heart of the issue. The Financial Action Task Force (FATF) has been advocating the implementation of a Risk Based Approach since 2007, and FinCEN's 2024 proposed AML CFT rulemaking further reinforced the industry's focus on effectiveness. Yet implementation remains one of the biggest challenges. Institutions still struggle to balance compliance with customer convenience. Excessive controls create customer friction, derisking, and lost revenue. Insufficient controls increase regulatory exposure. Technology can already provide much of the clarity the industry is looking for. At Shufti we have solved this challenge by effectively translating this policy into technology solution. The recent announcement by the Financial Intelligence Centre (FIC) that fewer than 12% of accountable institutions had submitted their mandatory 2026 Risk and Compliance Returns caught my attention. At first glance, it sounds like a compliance issue. I think it points to something much bigger. In my experience, organisations rarely struggle with regulatory reporting because they don't understand the regulations. More often, they struggle because they don't fully trust the data behind the report. Questions like: Which customer record is the correct one? Who owns this data? Is our KYC information current? Can we trace where this information came from? Are all our systems telling the same story? These are data governance questions before they're compliance questions. As regulators continue moving towards more intelligence led and data driven supervision, organisations can no longer treat reporting as a once off exercise. Data quality, ownership and governance have become strategic capabilities. This is especially true in AML, where every downstream control, from customer risk ratings and transaction monitoring to suspicious activity reporting, all depends on the integrity of the underlying data. Technology will continue to evolve. AI models will become more sophisticated. Detection rules will become smarter. But none of those investments can compensate for poor data. In today's regulatory environment, the real competitive advantage isn't producing a report when it's requested.
