With countryside access increasing, what role can Section 31 Deposits play? Across farms and estates, informal access routes can become established over time, particularly where paths are used regularly by walkers, dog walkers or hikers. Where this happens, there can be a risk of future Public Rights of Way claims. A Section 31(6) Deposit under the Highways Act 1980 can help protect a landowner’s position by recording acknowledged Public Rights of Way and confirming there is no intention to dedicate additional routes. These deposits must be prepared carefully, supported by accurate plans and statements, and renewed when required. Newton’s rural team works with landowners to review access across estates and farms, prepare compliant plans and statements, and liaise with local authorities through the registration process.
