Amongst accepted uses are notably, - drafting *suitable* contracts, - client onboarding and triage, - negotiating terms and - summarising and reporting to clients. What are not acceptable are: - emotional support - complex legal drafting Crucially, the author highlights that "it is important to understand how different genAI tools use and process data. Some tools may store prompts and responses to improve their models, while others offer enterprise-grade options that do not retain or reuse data." As a small practice leader, we have had to do our own research on data usage, processing and safety in leveraging off AI to deliver cost-effective solutions into the market. So, the UK Supreme Court has handed down their judgment on software exclusions from patentability, changing the UK's law and practice on this in a (seemingly) patentee friendly way. Under the new approach, a GB patent might be attractive as a way of securing protection and (perhaps more critically) unlocking valuable #patentbox relief. Nice milestone for the team: using their Patent Asset Index, LexisNexis ranked V-Nova Ltd. #2 among the most innovative UK-headquartered, private, active, for-profit companies founded since 2010. It’s a ranking that rewards impact, not just volume, by considering technology relevance (citation-weighted), market coverage, and global influence. Separately, UKIPO patent analytics indicate that V-Nova also features the top UK inventor by number of patents in 2025 and the fastest patent approval process recorded in UK history. Anyone given proper thought to data protection implications of Model Context Protocol? For the last few years at AWO Agency we have focused on locally run, open source, private models as our preferred way of experimenting with LLMs. This has allowed us to achieve almost everything we've wanted to with our specific use cases, without any compromises on privacy or security. With team members chatting with LLM models that are running locally on our machines, data stays on that machine and isn't shared with any third parties, there is zero risk of data ending up being used as training data, and makes data protection compliance a much more straightforward endeavor! However, with a number of our tools now supporting Model Context Protocol, use cases that were previously put to one side as infeasible or just too expensive, are potentially back on the table. We're about to start our security and data protection compliance review process to see if this is a path we want to go down (led by Mahdi Assan and Aldo Sghirinzetti) for some specific use cases. I imagine there are going to be a lot of hurdles (!) so who knows where it will land. If you've read something genuinely thoughtful compliance challenges around MCP, would you share? There weirdly doesn't seem to be a lot written up, and the things that are very security focussed, or appears themselves to be AI generated text! We'll share our assessments and conclusions for others to benefit from once completed. IP Audits I'm pleased to report that following discussions I've had with the The Chartered Institute of Patent Attorneys and Intellectual Property Office UK, the UKIPO has published some updated guidance to IP practitioners when conducting IP audits, highlighting some additional areas to review concerning standards essential patents. The guidance is targeted to IP practitioners carrying out IP audits for SMEs under the UKIPO's Audit scheme, which provides some funding for SMEs, but the questions are useful for IP audits more broadly. Training data does not constitute a copyright infringement for the AI model While this decision definitely requires further analysis it seems that in the landmark ruling from this week in Getty Images v Stability AI ([2025] EWHC 2863 (Ch)), one of the key take-aways is that the UK High Court concluded that “an AI model such as Stable Diffusion which does not store or reproduce any copyright works (and has never done so) is not an ‘infringing copy.’” Copyrighted images from Getty were apparently used to train Stability’s generative AI model, but the High Court held that a trained model isn’t a library of images but a network of statistical relationships. Getty’s secondary copyright claim failed on that basis. The ruling highlights tensions in what it means for data to reside within an AI model. According to the UK court, models as such do not contain or represent the data they were trained on. The implication is that IP infringement must be assessed on the level of generative output. In contrast, many EU regulators and regulations, including the EDPB and the AI Act, assume the opposite: that data may persist inside models and can (or must) be audited, erased, or disclosed. This tension sits at the heart of how generative AI should be governed. As AI evolves, policymakers, courts, and the AI industry will need to align on how the notion of “data in a model” is defined legally and operationally. The Getty ruling underscores the importance of distinguishing between “stored data” and “learned patterns”. The decision reduces the immediate IP infringement risk around AI training (at least in the UK) and shifts attention to the outputs that the models generate. #IntellectualProperty #CopyrightLaw #ArtificialIntelligence

Great day exploring how AI is reshaping IP practice at The Chartered Institute of Patent Attorneys Congress 2025. One standout moment was David Kappos’ keynote, where he shared his personal take on AI in IP and demoed the IPO Education Foundation’s “IP Buddy AI” tool. It’s an impressive example of how AI can enhance IP education and awareness - and don’t worry, it’s not here to replace us! It helpfully answered the demo question that you patent an invention, not copyright it - a conversation I’m sure every Patent Attorney has had.
